Zborník príspevkov z medzinárodného vedeckého seminára „Verejná správa ako poskytovateľ verejných služieb sociálneho štátu - využitie zahraničných skúseností pre reformy v Slovenskej republike“ konaného v priestoroch Fakulty verejnej správy UPJŠ, Popradská 66 v Košiciach 24.11.2017.

Verejné služby sú stále viac sa rozrastajúcim segmentom verejného sektoru. Jeho rast môžeme identifikovať najmä horizontálne – od služieb spojených s všeobecnou bezpečnosťou a ďalšími formami zabezpečenia fungovania štátu, cez služby technickej infraštruktúry, poštovné a telekomunikačné služby, dopravu a informačné služby až po stále viac akcentované služby zdravotníctva, kultúry a vzdelávania až po sociálne služby. Zároveň sa celá štruktúra verejných služieb rozrastá aj vertikálne, najmä do hĺbky: v každej z oblastí sa rozširuje škála poskytovaných služieb.

V súvislosti s tým narastá aj význam optimalizácie štruktúry poskytovateľov, čo je obsahom takých reformných procesov, akými sú deetaizácia, decentralizácia, dekoncentrácia, privatizácia či iné podoby transformácie tejto štruktúry. Výsledkom môže byť v rôznych podmienkach rôzna štruktúra poskytovateľov rôznych verejných služieb sociálneho štátu, medzi ktorými si naďalej udržiava významnú pozíciu štát a jeho orgány či organizácie.

V súvislosti s tým zase narastá význam modelu usporiadania verejnej správy ako hlavného štátneho poskytovateľa celého radu týchto služieb: v dôsledku týchto procesov vznikajú v rôznych krajinách rôzne a niekedy navzájom aj ťažko porovnateľné systémy poskytovateľov verejných služieb aj v rámci štátnych či z poverenia štátu pôsobiacich orgánov a organizácií. Faktom však ostáva rozdielna výsledná efektívnosť systémov poskytovania verejných služieb orgánmi verejnej správy.

Slovenská republika prechádza viac-menej nepretržite už skoro 30 rokov rôznymi aj keď nie vždy vzájomne koordinovanými procesmi, týkajúcimi sa rôznych oblastí verejných služieb a krížovo aj rôznych systémov a subsystémov verejnej správy. Systémovejší a ucelený pohľad na aktuálny výsledok týchto procesov však zatiaľ chýba, potreba takéhoto pohľadu je však zrejmá. Aj keď komplexné zmapovanie výsledkov a najmä dopadov nedostatočnej synchronizácie reformných procesov na Slovensku v uplynulých desaťročiach by zrejme vyžadovalo nasadenie veľmi rozsiahlych výskumných kapacít, môže aj parciálny ale pritom prierezový a krížový pohľad na priesečník reforiem verejnej správy a reforiem v oblasti školstva, sociálnych služieb a ďalších, priniesť nové poznanie do tejto oblasti.

Medzinárodný vedecký seminár, výstupom z ktorého je predkladaný zborník, mal za účel čo najširšie otvoriť súvislosti témy: preto sú v ňom zastúpené aj príspevky, týkajúce sa nielen najfrekventovanejších verejných služieb, akými sú sociálne služby či služby vzdelávaniam, ale napríklad aj bezpečnostných služieb a pod. Rovnako prierezovo do diskurzu vstúpili tak pohľady ekonomické, ako aj organizačné, právne atď. Bez nároku na komplexnoxť pohľadu – ktorý by mal byť výsledkom riešenia úlohy VEGA – sú tak vyznačené rôzne systémové súvislosti, ktoré by riešenie úlohy malo rešpektovať.

Presented publication is an outcome from the scientific conference for students and young scientists that took place on 12th and 13th May 2016 at the Department of Political science, Faculty of Arts, Pavol Jozef Šafárik University in Košice. The main aim of the presented is to bring up outcomes of research of young scientists and students from Slovakia, as well as from abroad. Many of the presented papers have become integral part of qualification theses of their authors.

This conference proceedings contains 22 papers in Slovak, Czech and English language thematically creating four different parts. Papers regarding international relations or issues exceeding a level of state power are dealing with issues of globalization, counterculture, international terrorism, extremism and a role of the EU in the Arctic. Papers dealing with the situation in the Slovak republic and abroad cover reform of security in Slovakia and in Romania, issue of dealing with totalitarian history of the states of the Visegrad group as well as development of funding of education system in Slovakia since 1919. In case of authors focusing on the socio-political situation in Slovakia we can find papers analyzing role of a reeve in city of Košice, first great political conflict during a rule of Vladimír Mečiar in Slovakia, role of Roma population in political environment in Slovakia, but also those concerning local activist or action groups and examining attitude of nursing care students towards euthanasia. The conference proceedings contents also four papers regarding theoretical or philosophical issues. Their authors focused on topic of social state, social equality, democratic theories and transformation of human nature in “post-human” era.

Recenzovaný zborník príspevkov z medzinárodnej vedeckej konferencie organizovanej pri príležitosti 20. výročia vzniku Fakulty verejnej správy Univerzity Pavla Jozefa Šafárika v Košiciach konanej dňa 15. novembra 2018 v Košiciach.

Dňa 15. novembra 2018 sa v priestoroch Fakulty verejnej správy Univerzity P. J. Šafárika v Košiciach konala medzinárodná vedecká konferencia „Verejná správa v súčasnom demokratickom a právnom štáte“. Vedeckým podujatím, ktorého sa zúčastnilo viac ako 60 odborníkov z domácich i zahraničných vysokých škôl a fakúlt, ale aj predstaviteľov rôznych inštitúcií z prostredia verejnej správy, si Fakulta verejnej správy pripomenula 20. výročie svojho vzniku. Prvá časť konferencie prebiehala v rámci plenárneho zasadnutia, druhá pokračovala rokovaním v štyroch sekciách, ktorých názvy sa zhodujú s prioritnou vedeckou orientáciou jednotlivých katedier fakulty. Na plenárnom zasadnutí, ako aj v odborných sekciách odznelo veľa obsahovo kvalitných a podnetných vystúpení, ktoré nesporne prispejú k ďalšiemu rozvíjaniu teórie verejnej správy – všeobecne, a k rozvíjaniu čiastkových vedeckých tém riešených katedrami fakulty – zvlášť. Vedeckú konferenciu sprevádzal pracovný charakter, kultivované vedecké a odborné prostredie, v jeho rámci nespočetné diskusie účastníkov viažuce sa k aktuálnym otázkam a problémom verejnej správy, ale aj formulovaniu návrhov na ďalšiu možnú spoluprácu v oblasti vedy a vzdelania. Fakulta vydáva z vedeckej konferencie recenzovaný vedecký zborník, ktorý bude mať dve časti, vzhľadom na veľký počet aktívnych účastníkov. V prvej časti sú zahrnuté tri vystúpenia z plenárneho zasadnutia korešpondujúce s obsahom príspevkov, ktoré odzneli v rámci rokovania sekcií garantovaných Katedrou verejnej politiky a teórie verejnej správy a Katedrou verejnoprávnych disciplín. V druhej časti sú dve vystúpenia z plenárneho zasadnutia, ktoré obsahovo súvisia s rokovaním sekcií garantovaných Katedrou sociálnych vied a Katedrou ekonomiky a riadenia verejnej správy. Poďakovanie patrí všetkým aktívnym účastníkom vedeckej konferencie, ale aj tým, ktorí sa na jej príprave a priebehu organizačne podieľali.

The competences of local self-government units, together with the state's participation in their execution, represent a combination of factors that substantially determine image of contemporary local self-government subsystem in Slovak Republic. Mentioned combination is not only a model that sets the way for the optimal adjustment of the local self-government functioning, but also represents authentic testimony of the state's attitude to the real importance of local self-government units as decentralized entity of public power. Conference proceedings have a cross-sectional character. In this sense, the papers are not limited by the views of a single discipline. However, the key contribution of included papers might be a comprehensive view, how to improve actual tensions in local self-government theory and practice, which from the conceptional point of view deals with issues of local self-government units. Moreover, it fulfils the ambition of multidisciplinary scientific analysis focused on the position and competences of the local self-government in the context of an economic, political and legal perspective.

Veľká väčšina týchto publikačných výstupov je pre domácich čitateľov pomerne ľahko dostupná či už v printovej alebo elektronickej podobe. Keďže však viacero kľúčových publikovaných výstupov je pre slovenských čitateľov z rôznych dôvodov menej prístupných, rozhodli sme sa ich v tomto zborníku reprintovať aspoň niektoré z nich v ich slovenskojazyčných verziách. Keďže všetky tu reprintované texty prešli pri svojom pôvodnom vydaní riadnym recenzným pokračovaním, nebolo už potrebné ich slovenskojazyčné verzie znovu recenzovať. Pri každej z publikovaných štúdií preto uvádzame bibliografické údaje jej pôvodného vydania, vrátane mien recenzentov, vedeckých redaktorov a pod.

Utilising Foreign Experience for Reforms in the Slovak Republic

The topic of our research task of the same name VEGA 1/0757/17 was based on the question – and was likewise defined in its approved project – how public administration as one of the providers of public services can act as efficiently as possible in favour of making these services available from the aspect (place of permanent residence) of the citizen. This can be done with a certain optimality in the structure of public administration, primarily at the local, but also at the supra-local, e.g. regional, level. If, for example, the settlement structure is too disintegrated, or conversely the regional structure is too aggregated (or even too fragmented), various alternative solutions must be sought that are rational and optimal for satisfying citizens and that will not waste public resources. In this, it is also questionable how the system of state administration authorities and local government authorities is reflected in this structure (in the case of known differences in their operation in both these regimes, or in a regime of delegated performance of state administration), including the conditions of funding these services as public services.

This level of the issue relates not just to competences in the field of social assistance, as sometimes emphasised in Slovakia, but relates to all competences that the state delegates to local government. The delegation of competences means not just the amendment of a law, but also creating conditions for its efficient application for which it is necessary that municipalities or regions perform delegated competences for a certain territory (e.g. for an appropriate number of inhabitants) (Bodnárová - Džambazovič 2011, pp. 20-21), or as M. Jílek (2008, p. 39) writes “an optimal number of citizens of a territorial self-government authority for a given quantity of goods provided will be determined by the maximum positive difference between total utility from consumption per person and total costs for providing the goods per person”. The requirement that municipalities and regions have available a public services infrastructure (Dušek 2016) must thus be confronted with certain capacity possibilities and efficiently and appropriately assessed by the need for various public services in relation to the territorial unit for which the infrastructure is to provide these services.

In terms of economic decentralisation, or fiscal federalism, this concerns the wellknown Oates decentralisation theorem, according to which any public service should be provided by a unit governing the smallest possible geographical area in which the costs and utility of the provided service can be internalised (Oates 1999), whereby the author very clearly highlighted the efficiency limits of decentralisation. This was something that was largely disregarded in Slovakia and surrounding countries at the start of the 1990s, with political arguments dominating (to bring the exercise of public power closer to the citizen).

It would thus be possible by means of economic modelling to determine normatively the most suitable size of units for each kind of public service, assuming that for various public services we would arrive at different sizes of these units for different public services – in the end some optimising compromise would still have to be found in order for there to be a meaningful, but in particular, realistic and applicable structure of these units in practice. We chose a different, non-normative approach, an empirical and analytical approach, characteristic (together with a comparison method) for public policy theory. It is based in general on the fact that we compared actually existing units operating as public service providers in various countries, and in this comparison we attempted to identify the limits of their efficient functionality. The benefit of this approach, in contrast to the previous normative approach, is that the solution offered is tangibly available in existing practice and is not simply a theoretical (calculated) concept.

Dynamicky se vyvíjecící současná společnost vytváří v občanech očekávání a požadavky, aby verejná správa byla efektivní, spolehlivá, otevřená, profesionální a rychlá. Nové teorie poznatků v souvislosti s neustálými změnami však musí obsahovat i praktické uplatnění a promítnutí těchto charakteristik v systému veřejné správy v praxi. Právě z toho důvodu je důležité věnovat pozornost novým přístupům z teoretického i praktického pohledu k uplatňování moderní veřejné správy v podmínkách krajin V4. Vzhledem ke skutečnosti, že veřejná správa je interdisciplinární vědní disciplína, která využívá poznatky z široké škály vědních odborů a na základě toho umožňuje komplexně přistupovat k řešení problémů moderní veřejné správy, je recenzovaný sborník příspěvků z vědecké konference doktorandů rozdělen do třech sekcí: sociálno-ekonomické, politologické, právní. Sekce erudovaně reagují na současné problémy veřejné správy z teoretického i praktického hlediska.

A work entitled “General Establishment - Interpretation of Competences. A peer-reviewed collection of papers from the scientific conference." is a summary output of 25 papers presented at the scientific conference, which took place online on November 9, 2021. The conference was the final activity in solving the scientific research project entitled "Competences of Municipal Self-Government and the State's Participation in Their Implementation", implemented at the Faculty of Public Administration, University P.J. Šafárik in Košice with the financial support of the Scientific Grant Agency under no. 1/0367/19. The contributions provide a multidisciplinary view of the still living topic of defining competencies in the performance of the administration of the municipal territory between the state and the municipality, as the basic unit of territorial self-government in Slovakia. The articles analyze the issue from the perspective of not only administrative or constitutional law, but it is also possible to find among them those that describe problems and propose solutions at the political and economic level.

Social justice as a key value of social policy is an integral part of the social security system of every democratic and legal state of Western Civilization.The scientific monograph focuses on social justice in the old-age pension system in the Slovak Republic within diapason 2004 - 2022. The attention is dominantly focused on II., the so-calledcapitalization pension pillar.The aims of the scientific monograph correspond to the selected aims formulated as part of the project VEGA 1/0290/20 Social justice and old-age pension savings in the Slovak Republic.The main aim of the monograph is to identify the perception of social justice in the capitalization pillar of old-age pension savings through the value orientations of savers who are deciding to invest in funds II.pillar, as models created by relevant political representations in the Slovak Republic.

The methodological manual is thematically focused on the identification and analysis of key problems of self-government of "small" municipalities in selected areas. We specified the basic areas: financing of municipal competences, waste management and its financing, management of municipal waste. Subsequently, attention is paid to the creation of appropriate strategic solutions to the identified problems through a methodological manual, while maintaining the basic principles of public administration. The result of our identification and subsequent analysis of selected problems is to offer possible solutions and point out the justification of the need to solve selected problems of self-government, which can be used in practice and offer possible solutions to correct the negative situation.

Collection of contributions from 8th annual conference of the international doctoral conference "Theory and Practice of Public Administration", which took place on February 17, 2023 online through Microsoft Teams under the auspices of the Faculty of Public Administration of the Pavol Jozef Šafárik University in Košice. The conference was attended by 32 doctoral students from the Slovak Republic, Ukraine, and African countries. The conference allowed the participants to present the results of their scientific research activities in the field of public administration. The conference participants were divided into 4 sections according to the topic of their contribution. In the political science section, the participants presented contributions thematically focused, for example, on the solution of green issues in the Slovak Republic or the influence of the political culture of the inhabitants of the Slovak-Ukrainian border on local and regional political processes. The social section provided a space for presenting contributions and discussing, for example, the impact of the COVID-19 pandemic on marginalized groups in the Slovak Republic. In the economic section, participants presented contributions from, for example, the field of waste management or the impact of employing foreigners on the economy of the Slovak Republic. The legal sections dealt with, for example, the topic of current changes in public procurement, the activities of VÚC councils or the protection of personal data of minors in the online space.
