The Collection of scientific contributions "Privatization of public law versus publicity of private law" is an output of the International scientific conference of Phd. students and scientific researchers organized by the Department of Criminal Law, Faculty of Law, Pavol Jozef Šafárik University.

The collection contains contributions focused on the issues of the intersection of private and public law, specifically on the privatization of public law and publicity of private law. This is a highly important topic, because the elements of privatization can be found across the entire public law, not only in the field of criminal law, but also in other legal branches of public law.Recently, there have been significant elements of publicity of private law, especially commercial or civil law. Therefore, we consider the topic of the conference and the title of the collection to be appropriately chosen and up to date without any significant limits in scientific research. The participants of theInternational scientific conference in their contributions also focused on de lege ferenda considerations and offer a new perspective on the formation of public or private law.

The aim of the published Collection of scientific contributions isto continue in improving and developing new knowledge of the public law in the field of its privatization and private law in the field of its publicity.

Predkladaný zborník vedeckých prác je výstupom zo 4. ročníka medzinárodnej vedeckej konferencie Košické dni súkromného práva IV. organizovanej Katedrou občianskeho práva, Právnickej fakulty UPJŠ v Košiciach. Publikačné výstupy autorov sú tematicky orientované najmä na výskumný projekt VEGA č. 1/0765/20 "Ochrana ľudských hodnôt v súkromnom práve v kontexte moderných trendov a prebiehajúcej rekodifikácie súkromného práva" riešený organizátormi konferencie. Jednotlivé príspevky sú rozdelené do troch sekcií – občianske právo hmotné, civilné právo procesné, právo duševného vlastníctva. Rozdelenie sekcií reflektuje na jednotlivé výskumné oblasti vymedzené v rámci projektu.

Zborník z XIII. ústavných dní s názvom „Konanie o súlade právnych predpisov – návrhové oprávnenie a účinky rozhodnutí ústavného súdu“ reflektuje novú právnu úpravu účinnú od 1. januára 2025, konkrétne čl. 127 ods. 5 Ústavy SR, ktorá rozširuje právomoci sťažovateľov iniciovať konanie o súlade právnych predpisov prostredníctvom Ústavného súdu Slovenskej republiky. Príspevky renomovaných odborníkov mapujú teoretické aj praktické výzvy spojené s touto novou kompetenciou. Zborník tematicky pokrýva otázky týkajúce sa iniciačných mechanizmov senátov Ústavného súdu, derogačných a časových účinkov rozhodnutí či komparatívnych skúseností z Českej republiky, Maďarska a Poľska. Publikácia zároveň ponúka reflexiu širších javov, ako je judicializácia politického života, či rast implicitných právomocí ústavných súdov. Niektoré príspevky sa zameriavajú na otázky právnej istoty a retroaktivity derogačných nálezov, najmä v konaniach iniciovaných všeobecnými súdmi. Iné analyzujú aplikačné dopady spojenia individuálnej ústavnej sťažnosti a abstraktnej kontroly právnych predpisov. Publikácia obsahuje aj úvahy o ústavnoprávnych dôsledkoch porušenia konzultačnej povinnosti s Európskou centrálnou bankou. Nechýbajú reflexie o možnostiach ústavného preskúmania noriem v oblasti rozpočtovej zodpovednosti. Zborník ponúka pestrú škálu domácich aj komparatívnych prístupov k výzvam spojeným s novou rozhodovacou agendou. Je tak hodnotným príspevkom do diskusie o posilnení ochrany ústavnosti v Slovenskej republike.

The presented monograph, “Regionalism and Its Contribution to General International Law,” was prepared at the Institute of European Law and the Department of International Law of the Faculty of Law at Pavol Jozef Šafárik University in Košice as part of a project of the same name (APVV-0823-11) carried out in the years 2011–2015, and represents one of its final publication outputs.

The main reason for choosing this topic was the effort to evaluate regionalism in its various forms in relation to international law, and, conversely, to assess the place, significance, and role of international law in the creation and functioning of different forms of regional groupings. In fact, although regionalism is receiving increasing attention in doctrine, a more comprehensive assessment of its impact on international law and vice versa has so far been lacking.

This monograph attempts to partially fill this gap. Against the background of a brief historical development of regionalism, as well as its substantive and terminological components, the monograph examines in greater detail the individual types of regionalism—such as old and new regionalism, as well as contractual and institutional regionalism—their specific features, and their contribution to general international law.

Attention is also devoted to a specific phenomenon of contemporary regionalism, namely the influence of the European Union on its stabilization and development, both through practical measures and through a set of measures regulated by international treaties.

Health determines an individual's life in all activities and interests, including the possibility and ability to work. Work and health are in the mutual interaction. Work leads to social inclusion, financial self-sufficiency, finding confirmation of one's own usefulness or achieving personal ambitions. Work can have therapeutic effects, but at the same time it can have an adverse effect on health.

Overlapping factors of work environment, alone or in combination with non-work influences, can lead to illnesses that temporarily or permanently exclude an employee from his or her profession. For these reasons, health enjoys fundamental legal protection as one of the most important values, not only in labour relations.

The collection of scientific papers was created as part of a scientific seminar entitled “Extraterritorial Effects of Foreign Administrative Decisions in the Conditions of the European Union – Starting Points and Current State,” held from November 23 to 25, 2022, at the training and educational facility in Danišovce, in connection with the implementation of a scientific project entitled “Extraterritorial Effects of Foreign Administrative Decisions in the Conditions of the European Union,” supported by a grant from the Scientific Grant Agency under No. 01/187/2022.

The aim of the mentioned project is the scientific examination of extraterritoriality, i.e., the extraterritorial effects of administrative decisions of the Member States of the European Union on the territory of other Member States, in order to assess the need for, possibilities of, and desirable scope of harmonization of the legal regulation of the Member States of the European Union, with the goal of increasing the level of free movement of administrative decisions within the European Union. As part of the research project, an initial scientific seminar was held under the title “Extraterritorial Effects of Foreign Administrative Decisions in the Conditions of the European Union – Starting Points and Current State.”

Members of the research team, who are also members of the Department of Constitutional Law and Administrative Law at the Faculty of Law of Pavol Jozef Šafárik University in Košice, participated in this scientific seminar. At the seminar, contributions were presented that primarily summarized the current state of knowledge in the area of extraterritorial effects of foreign administrative decisions in the context of the European Union. This summary will serve as a basis for the further scientific examination of this issue by the members of the research team. These contributions subsequently formed the scientific papers included in this collection.

The proceedings offers contributions from the international scientific conference of doctoral students and young researchers held on 25 April 2024 at the Faculty of Law, UPJŠ in Košice, which was thematically oriented on Innovative Law and Innovations in Law. The authors of the papers confirmed that innovation in law can take many forms. The first part of the papers, which pays attention to how law can respond to innovations, is a manifestation of this. These are the papers by Jana Cihanová, Andrej Oriňák, Denisa Rudžiková and Matej Biroš, who presented the use of deepfake technology, artificial intelligence and software tools in legal practice in the context of their legal regulation. Looking at familiar things differently can also be a source of innovation. In this vein, Dominik Mizerski, Juraj Valentovič, Lucián Török and Kateřina Hrabánková presented interpretive and application innovations in the field of private law. The third part of the papers by Michaela Szittyaiová, Natália Priateľová, Filip Baláži, Elena Lazoríková and Laura Gazdagová offers a preview of the innovations that the public law section is facing today. Finally, the fourth and last group of papers specifically explains innovations against the background of criminal law regulation. These are contributions by Michal Novák, Miroslav Srholec, Vladimír Petrila and Martina Makaturová. The variety of topics covered in this proceedings shows that each area of legal regulation can be characterised by specific innovations and, in this context, by the dynamics with which they permeate legal regulation.

Pri hodnotení informačného veku sa ťažko uhýba streľbe fráz. Moderné technológie, internet, smartfóny, komunikačná technológia, či sociálne siete zmenili rytmus života na nepoznanie a svojim dosahom prekvapili aj samotných tvorcov. Možno takéto strohé hodnotenie znie až priveľmi povedome, snáď ako mnohokrát vyslovená fráza, ale je vskutku pravdivé. Rýchlo, obratom, hneď. ASAP. Heslá dnešnej doby. Pracovný život nevynímajúc. Namiesto uľahčenia práce a možnosti zosúladenia pracovného a rodinného života, čo je stále nenaplneným snom modelu flexikurity, moderné technológie prepletajú voľný čas s tým pracovným a nedokážu ich od seba oddeliť. Zamestnávateľ prostredníctvom emailu kladie požiadavky na neustálu online zapojenosť, z jeho pohľadu odpoveď možno zaberie iba pár minút, ale pripravený máme byť takmer vždy. Výsledkom je nezdravý, nadmerný, ba neustály stres. Stres sa stal takým fenoménom nového pracovného sveta, že mladí uchádzači o prácu sa vzájomne predbiehajú v tom, že práve oni vedia pracovať pod stresom, bez obáv zvládajú stresové situácie, dokonca majú stres radi, vyhľadávajú ho a túžia v stresovom prostredí pracovať. Nuž, nevedia, nezvládajú a netúžia ... ak, iba dočasne.

Nové stresové faktory sú predmetom skúmania nielen prírodných vied, najmä medicíny, ale aj humanitných vedných odborov, vrátane psychológie a práva. Autor tohto predhovoru s potešením konštatuje, že viacerí odborníci z týchto tieto zdanlivo vzdialených odborov sa stretli na spoločnej konferencii pod gesciou grantovej úlohy APVV-16-0002 Duševné zdravie na pracovisku a posudzovanie zdravotnej spôsobilosti zamestnanca a vzájomne si vymieňali poznatky a myšlienky. Vzájomná interdisciplinárna interakcia sa stáva základom pre nové poňatie problematiky a inšpiratívne metódy skúmania.

Zborník predstavuje výsledky prednesov prezentovaných na spoločnej konferencii s názvom Starostlivosť o zdravie zamestnancov, ktorá sa konala v dňoch 6. až 8. júna 2018 v Hornom Smokovci, vo Vysokých Tatrách. Veríme, že jeho obsah zaujme a podnieti i vás, čitateľov.
