Štvrté, doplnené a rozšírené vydanie koncepčne nadväzuje na doterajšie vydania a najmä sa nedotýka častí autorsky spracovaných Karolom Rebrom. Rozšírená je piata časť učebnice zameraná obsahovo na inštitúty vecného práva. Podstatným spôsobom je doplnený výklad o vecnom práve v celej jeho šírke vložením drobných úvah týkajúcich sa základných otázok rímskeho súkromného práva v oblasti vecnoprávnych vzťahov (ius in re). Miestami ide o nové spracovanie, miestami o rozšírenie poznatkov z danej matérie. V konkrétnostiach sa zväčšil rozsah v náuke o veciach (druhové a individuálne veci, prípadne zastupiteľné a nezastupiteľné veci), v náuke o držbe je novonačrtnutý problém držby ako faktu a držby ako práva, otázka „dobromyseľnej“ držby a rozšírenie výkladu o ochrane držby (interdiktná ochrana, posesórny a petitórny spor). V časti o vlastníckom práve došlo k precizovaniu druhov vlastníckeho práva, rozšírený je výklad o pôvodných spôsoboch nadobudnutia vlastníckeho práva, čím sa stal prehľadnejším. V náuke o vydržaní je upresnený problém dobromyseľnosti. Osobitnú pozornosť si zaslúžil výklad o tradícii doplnený o nové dôležité skutočnosti. Prepracovaný je ďalej výklad o reivindicatio a o postavení procesných strán v tomto súdnom spore, takisto aj actio negatoria a actio Publiciana. Úplne novým je zapracovanie pojmu vecné práva k cudzej veci (iura in re aliena) najmä v porovnaní s vlastníckym právom (iura in repropria). V náuke o záložnom práve sa zmeny týkajú podstaty a účelu rímskeho záložného práva, rozšírený je výklad o fidúcii a právnom postavení záložného veriteľa a záložného dlžníka k založenej veci. Napokon pribudol register latinských právnych pravidiel uvedených v texte učebnice.

The Convention on the Protection of Human Rights and Fundamental Freedoms and the case-law of the ECtHR represent a decisive legal instrument for the evolution of the right to a fair trial in the member states of the Council of Europe and the European Union, including the Slovak Republic, which affects the minimum level of procedural guarantees for individuals in judicial and administrative proceedings.

The primary purpose of the textbook is to fill the gap consisting in the absence of a comprehensive study text for undergraduate students at Pavol Jozef Šafarik University in Košice, Faculty of Law for the planned subject Right to a fair trial in administrative issues, and doctoral students at this faculty for the subject Protection of fundamental rights and freedoms in criminal matters according to the case-law of the ECtHR.

However, this textbook is also intended as a supplementary study aid for bachelor students in order to deepen their knowledge of the subject Administrative Law II, the result of which is to acquire knowledge about procedural administrative law in the Slovak Republic, as well as the subject of European Administrative Law, the result of which is the acquisition of knowledge about the influence of Council of Europe law on the national administrative law of the Slovak Republic.

The monograph deals with two fundamental aspects concerning evaluation of evidence in the law. In the first part, the monograph addresses the question: „How it is possible to apply law in individual case, if human knowledge about past is objectively limited and flawed?“ (e.g. what is the nature of truth in the law?). The second part of the monograph identifies certain models of reasoning concerning factual questions which occur across different individual legal cases (especially tax cases and criminal cases). In that regard, the monograph draws from Anglo-American legal scholarship and deals with three main concepts concerning evaluation of evidence: argumentation, probability and narratives and their role in evaluation of evidence.

The monograph is the output of the grant project APVV no. 16-0160 which deals with the issue of tax evasion and tax avoidance (especially their motivating factors, emergence, and elimination). The author believes that better understanding of evaluation of evidence may contribute to the improvement in effectiveness of tax administration.

The Industrial Revolution cannot be avoided or hidden from, but it is equally wrong to see it only in gray tones. Let us be optimistic. The Information Age can also mean a reduction in working hours, perhaps more time for family and interpersonal relationships, or an overall increase in individual economic luxury. The Information Age will take away many job opportunities but will put many others on the table, though mostly for the educated. Science and research will become even more important for overall economic development than they are today. Let us be prepared.

The ambition of this monograph is not, and cannot be, to provide an exhaustive answer to the above-outlined debates. Its goal is to stimulate broader scientific discussion, particularly on the issue of mental health protection in correlation with the advent of the Information Age. The subject of study is the protection of the individual—the employee—who must adapt to a new technological environment and its associated demands.

The monograph represents a comprehensive output by authors who, over the past two years, have published on similar topics within the APVV-16-0002 grant "Mental Health in the Workplace and Assessment of Employee Health Capability." The authors believe that thanks to this APVV grant, they will continue to build on this topic in the coming years. Most importantly, they hope that its content will engage you, the readers.

Zborník z III. študentského sympózia z obchodného práva

V novembri 2015 sa v univerzitnom účelovom zariadení v Danišovciach uskutočnil už tretí ročník študentského sympózia z obchodného práva. Po dvoch rokoch sympózií zameraných na právo obchodných spoločností bola strešnou témou tretieho ročníka všeobecná časť obchodného záväzkového práva. Aj v tomto roku ostalo cieľom študentského sympózia vytvoriť väčší priestor formulovať vlastný pohľad na určitú aktuálnu právnu problematiku a prezentovať výsledky vlastnej práce.
Strešná problematika umožnila zadať viaceré aktuálne témy a študenti tak mohli spracovať problémy, s ktorými sa pravdepodobne budú boriť aj v budúcej praxi. Zvolené témy nepatria medzi témy jednohlasne vnímané právnou doktrínou, resp. ustálenou judikatúrou. Práve naopak, zámerne boli zvolené témy, o ktorých niet mnoho tuzemských literárnych zdrojov. Na spracovanie jednotlivých tém tak nepostačovali bežné učebnicové či komentárové znalosti.
Zapojení členovia katedry, tak z radov učiteľov, ako aj doktorandov, pôsobili aj v tomto roku skôr ako kontaktné osoby, než ako konzultanti či vedúci práce študentov.
Primárnym účelom sympózii na fakulte je umožniť študentom prejavujúcim záujem o obchodné právo rozvinúť analytické či argumentačné schopnosti, ale aj prejavenie osobnosti študenta. Chceme, aby poslucháči rozvíjali nielen odborné znalosti, ale aj osobné schopnosti, tzv. soft skills, umenie prezentovať vlastný názor a presvedčivo argumentovať.
Výsledky práce študentov môžete vidieť v tomto zborníku.
Nám ostáva dúfať, že aj iní poslucháči budú mať záujem prehĺbiť svoje poznatky a prezentovať výsledky vlastnej práce na nasledujúcich sympóziách. Veríme, že školské kurikulum sa už nadlho podarilo rozšíriť o ďalšie fakultatívne podujatie.

As part of the professional program, there will be five plenary lectures by prominent experts from Pavol Jozef Šafárik University in Košice and Comenius University, and one workshop will be held. A total of 47 full-time doctoral students will present the results of their scientific research work, of which 23 doctoral students in the section of medical and natural sciences (Faculty of Medicine/Faculty of Science) and 24 doctoral students in the section of social sciences and humanities (Faculty of Law/Faculty of Public Administration/Faculty of Arts). Part of the professional program of the event will be a panel discussion with the Management of Pavol Jozef Šafárik University in Košice.

The world of diplomacy, whether ancient or modern, is naturally prone to problems associated with cultural clashes and often serves as an “unarmed battlefield” of cultural concepts. International diplomacy, however, stands on the assumption of war, as misunderstandings and cultural discrepancies lead to confusion. Cultural encounters also provide many opportunities for the choice of misunderstanding: the choice to perceive an act as an insult, even if unintended, or the choice to ignore the most blatant intentional insult, all according to momentary expediency.

The Roman historian Livy recounts an anecdote about the gates of the Temple of Janus, which, when open, signified that Rome was at war. However, the doors of the ancient Temple of Janus were closed only twice from the beginning of the 7th century BC to the end of the 1st century BC. One might ask, how many times and for how long after the signing of the Treaty of Trianon were the metaphorical gates of the European (or global) Temple of Janus closed?

The publication that the reader holds in their hands does not attempt to exhaustively answer all questions of ancient and modern international diplomacy. That is neither possible nor the goal of this scientific monograph. Authors seeking intersections between diplomacy of antiquity, the Middle Ages, and the early 20th century encountered some thought-provoking ideas and controversial debates. Indeed, what other conclusions can the topic of the Treaty of Trianon and the perpetual clash of cultures in the Mediterranean antiquity and medieval Europe bring?

We believe that the topic of ancient and modern diplomacy will inspire the reader and stimulate the professional public to new ideas, reflections, and scholarly activity.

The scientific monograph was prepared as an output of the project of the Agency for the Support of Research and Development No. APVV-19-0419: "100 years of the Treaty of Trianon."

Zborník príspevkov zo VII. ročníka študentského sympózia z medzinárodného práva konaného v dňoch 11. – 12. apríla 2014 v učebno-výcvikovom zariadení UPJŠ v Danišovciach

Napriek tomu je dnes lietanie a cestovanie do kozmu bežnou súčasťou ľudskej civilizácie. Aká je úloha práva v tomto procese? To je otázka, ktorú si položili organizátori VII. ročníka študentského sympózia z medzinárodného práva sledujúc ambíciu zhodnotiť prínos medzinárodného práva v oblasti letectva a kozmických letov najmä vo svetle aktuálneho vývoja. Jednotlivých tém sa zhostili študenti druhého, tretieho, ale aj vyšších ročníkov Právnickej fakulty UPJŠ v Košiciach. Výsledkom ich práce na zverených témach, ktoré mohli autori konzultovať s členmi Ústavu európskeho práva a oddelenia medzinárodného práva, je predkladané dielo. Zborník je tematicky rozdelený na dve časti. Prvá časť oboznámi čitateľa s vybranými témami súvisiacimi s leteckým právom a druhá časť je venovaná medzinárodnému kozmickému právu. Svojim zameraním má zborník aj širší dosah, keďže v niektorých aspektoch zapadá do širšieho kontextu výskumu, ktorý prebieha na Ústave európskeho práva a oddelení medzinárodného práva a ktorý sa zameriava na skúmanie vplyvu regionalizmu na všeobecné medzinárodné právo a vice versa. Túto problematiku odrážajú aj témy jednotlivých príspevkov.

The Student Symposium on International and European Law has its traditional place in the calendar of events at the Faculty of Law of Pavol Jozef Šafárik University in Košice. In the academic year 2019/2020, the Institute of International Law and European Law decided to continue this tradition and offer students an opportunity to present their professional opinions on selected topics and problematic issues of international and European law.

The XIII. edition of the student symposium continued from its previous year and once again focused students' attention on the institutions of international and European law depicted in films. The films processed by the participants of the symposium offer a wide range of institutions of international and European law.

In their contributions, participants addressed issues related to diplomatic law, terrorism, armed conflicts, the use of robots, environmental protection, and questions regarding the legal regime of outer space.

The Department of Commercial Law and Economic Law at the Faculty of Law of Pavol Jozef Šafárik University in Košice organized the fourth edition of the student symposium, this time focusing on corporate law.

The event took place on November 24-25, 2016, at the training facility of Pavol Jozef Šafárik University in Danišovce. The aim of the annually organized symposiums is to create a discussion platform for students with the participation of mentors from the department, including teachers, researchers, and doctoral students. This year’s symposium focused on problematic issues related to the legal status of a partner in a commercial company. The topics were assigned to allow students to demonstrate and develop their analytical and argumentative skills while improving their ability to present and formulate their own views and perspectives.

The presented proceedings are the outcome of the students' work from this event.

Učebný text z teórie práva sa pokúša priblížiť a objasniť právo vo všetkých dôležitých javových formách predovšetkým študentom prvého ročníka právnického štúdia a má propedeutický charakter. Vychádza z historického vývoja názorov na pojem právo a zo skúmania jeho rôznych významov. Hľadá spoločné znaky a odlišnosti medzi právnymi normami a inými normami správania (morálka, spravodlivosť). Dôraz kladie na skúmanie práva ako súboru právnych pravidiel vydaných a uznaných legitímnou autoritou, záväzných pre všetky subjekty právnych vzťahov. Klasifikuje systém práva a jeho štruktúru. Od tvorby práva prechádza k prameňom práva, so zreteľom na systém práva Slovenskej republiky, ale aj Európskej únie. V nadväznosti na pramene práva predkladá analýzu právnych noriem: ich pojem, znaky, štruktúru, druhy a pôsobnosť. Právne vzťahy vo svetle ich predpokladov a prvkov chápe ako vzťahy upravované právnymi normami. S realizáciou a aplikáciou práva súvisí výklad práva, spojený s otázkami analógie v práve. Právna zodpovednosť je prezentovaná ako ústredná právna kategória vychádzajúca zo schopnosti (nevyhnutnosti) niesť následky svojho konania: predmetom pozornosti sú predovšetkým objektívna zodpovednosť a subjektívna zodpovednosť. Záverečná časť sa týka právneho štátu ako ideálneho „miesta deja“ vo vzťahu k opísaným formám práva a ich uskutočňovaniu, zaoberá sa historickým vývojom i súčasným stavom modelov Rechtsstaat – Rule of Law, ako aj princípmi ich fungovania. Učebný text má poskytnúť orientáciu v základných pojmoch a odkázať na bohaté zdroje odbornej literatúry, ktoré možno študovať paralelne.

Zborník príspevkov z konferencie

V dňoch 11. a 12. júna 2015 zorganizovala Katedra obchodného práva a hospodárskeho práva Právnickej fakulty Univerzity P. J. Šafárika v Košiciach už v poradí 13. stretnutie katedier obchodného práva Právnických fakúlt univerzít Českej republiky a Slovenskej republiky, čo len dokumentuje, že myšlienka každoročného stretávania sa predstaviteľov katedier obchodného práva, ktorú incioval prof. Bejček z Právnickej fakulty Masarykovej univerzity Brno, padla na úrodnú pôdu a verme, že takéto stretnutia budú pokračovať aj naďalej. Nielen pre zachovanie tradície ale hlavne pre osožnosť takýchto stretnutí a záujem ich účastníkov stretávať sa.

Tradičnou súčasťou týchto stretnutí, okrem výmeny poznatkov a informácií z realizácie pedagogického procesu a výmeny skúseností je aj vedecká konferencia zameraná na aktuálne otázky obchodného práva. Tohtoročná konferencia sa uskutočnila pod názvom Slovenské a české obchodné právo v roku 2015 – Vybrané problémy. Z jednotlivých katedier je do zborníka z konferencie zaradených celkom 17 príspevkov, ktoré sú rozdelené do troch problémových okruhov. Prvý okruh príspevkov tvoria príspevky tematicky zamerané na vybrané problémy právnej úpravy obchodných spoločností a jej praktickej realizácie. Do druhého okruhu sú zaradené príspevky orientované na oblasť rozhodcovského konania a na konkurzné právo. Do ostatného okruhu sú zaradené príspevky zamerané na výklad novelizovanej úpravy úrokov z omeškania v obchodných záväzkových vzťahoch a na problémy pri aplikácii tejto úpravy, na problematiku výkladu právnych úkonov úpravy obsiahnutej v novom českom Občianskom zákonníku. Súčasťou tejto časti je tiež informatívny príspevok o vývoji slovinského obchodného práva a jeho súčasnej podobe.

Collection of Contributions from the XVth Student Symposium on International Law and European Law, held on April 22, 2022, in a hybrid format, with the participation of students from the Faculty of Law of Pavol Jozef Šafárik University in Košice and the Faculty of Law of Trnava University in Trnava.

The jubilee XV. year of student symposium from international and European law took place at the University of Pavol Jozef Šafárik, faculty of law, on April 22, 2022, symbolically on Day Earth. This year's event was dedicated to the increasingly pressing issue of environmental protection. The topic "Green ambitions in the light of European and international law" appealed to many students, resulting in several interesting contributions, falling under both European Union law and international law. European law currently brings great challenges, but also expectations through the European Green Deal. This is also why several student contributions dealt with topics falling under the European Green Deal, either from the point of view of its individual initiatives in general, or more specifically, in the intentions of Agenda 2030, or the implementation of the so-called green diplomacy.

The other part of contributions dealt with environmental protection within international law. Students addressed issues of an environmental nature in the areas of climate change, international maritime law, atmospheric protection, or the issue of so-called climate refugees. The publication itself is an output of the APVV project APVV-20-0576 "Green ambitions for sustainable development (European Green Deal in the context of international and national law)".

Podstatným spôsobom je doplnený výklad o vecnom práve v celej jeho šírke vložením drobných úvah týkajúcich sa základných otázok rímskeho súkromného práva v oblasti vecnoprávnych vzťahov (ius in re). Miestami ide o nové spracovanie, miestami o rozšírenie poznatkov z danej matérie. V konkrétnostiach sa zväčšil rozsah v náuke o veciach (druhové a individuálne veci, prípadne zastupiteľné a nezastupiteľné veci), v náuke o držbe je novonačrtnutý problém držby ako faktu a držby ako práva, otázka „dobromyseľnej“ držby a rozšírenie výkladu o ochrane držby (interdiktná ochrana, posesórny a petitórny spor). V časti o vlastníckom práve došlo k precizovaniu druhov vlastníckeho práva, rozšírený je výklad o pôvodných spôsoboch nadobudnutia vlastníckeho práva, čím sa stal prehľadnejším. V náuke o vydržaní je upresnený problém dobromyseľnosti. Osobitnú pozornosť si zaslúžil výklad o tradícii doplnený o nové dôležité skutočnosti. Prepracovaný je ďalej výklad o reivindicatio a o postavení procesných strán v tomto súdnom spore, takisto aj actio negatoria a actio Publiciana. Úplne novým je zapracovanie pojmu vecné práva k cudzej veci (iura in re aliena) najmä v porovnaní s vlastníckym právom (iura in repropria). V náuke o záložnom práve sa zmeny týkajú podstaty a účelu rímskeho záložného práva, rozšírený je výklad o fidúcii a právnom postavení záložného veriteľa a záložného dlžníka k založenej veci. Napokon pribudol register latinských právnych pravidiel uvedených v texte učebnice.

However, this textbook is also intended as a supplementary study aid for bachelor students in order to deepen their knowledge of the subject Administrative Law II, the result of which is to acquire knowledge about procedural administrative law in the Slovak Republic, as well as the subject of European Administrative Law, the result of which is the acquisition of knowledge about the influence of Council of Europe law on the national administrative law of the Slovak Republic.

The monograph deals with two fundamental aspects concerning evaluation of evidence in the law. In the first part, the monograph addresses the question: „How it is possible to apply law in individual case, if human knowledge about past is objectively limited and flawed?“ (e.g. what is the nature of truth in the law?). The second part of the monograph identifies certain models of reasoning concerning factual questions which occur across different individual legal cases (especially tax cases and criminal cases). In that regard, the monograph draws from Anglo-American legal scholarship and deals with three main concepts concerning evaluation of evidence: argumentation, probability and narratives and their role in evaluation of evidence.

The monograph is the output of the grant project APVV no. 16-0160 which deals with the issue of tax evasion and tax avoidance (especially their motivating factors, emergence, and elimination). The author believes that better understanding of evaluation of evidence may contribute to the improvement in effectiveness of tax administration.

The Industrial Revolution cannot be avoided or hidden from, but it is equally wrong to see it only in gray tones. Let us be optimistic. The Information Age can also mean a reduction in working hours, perhaps more time for family and interpersonal relationships, or an overall increase in individual economic luxury. The Information Age will take away many job opportunities but will put many others on the table, though mostly for the educated. Science and research will become even more important for overall economic development than they are today. Let us be prepared.

The ambition of this monograph is not, and cannot be, to provide an exhaustive answer to the above-outlined debates. Its goal is to stimulate broader scientific discussion, particularly on the issue of mental health protection in correlation with the advent of the Information Age. The subject of study is the protection of the individual—the employee—who must adapt to a new technological environment and its associated demands.

The monograph represents a comprehensive output by authors who, over the past two years, have published on similar topics within the APVV-16-0002 grant "Mental Health in the Workplace and Assessment of Employee Health Capability." The authors believe that thanks to this APVV grant, they will continue to build on this topic in the coming years. Most importantly, they hope that its content will engage you, the readers.
