Reviewed proceedings from the student symposium organized on the occasion of IV. Slovak-Czech days of tax law.
The International Scientific Conference IV. Slovak-Czech days of tax law was held 16th - 18th June 2021 in Košice (Faculty of Law of Pavol Jozef Šafárik University in Košice). On this occasion, a student symposium on the topic: "Current Challenges of Tax Law" was organized for students of the Pavol Jozef Šafárik University Faculty of Law in Košice on 15th June 2021. The focus of the symposium was chosen due to the content of the grant project APVV-19-0124 entitled "Tax law and new phenomena in the economy (digital services, shared economy, virtual currencies)", which is currently being addressed at the Department of Financial Law, Tax Law and Economy, Faculty of Law, Pavol Jozef Šafárik University in Košice. The output of this symposium is a reviewed proceeding of papers, in which students focus on examining the current challenges of tax law. In this context, students examine not only the current challenges in the field of real estate tax and the introduction of taxation based on their market value of real estate, the decision-making of the Court of Justice of the European Union in the field of direct taxation and indirect taxation, but also new and extremely current taxation issues of cryptoactive (virtual currency) taxation, not only in the Slovak Republic but also in the world. The authors also assess in detail the current situation in the research area, and they also present de lege ferenda proposals that could contribute to the development and improvement of several aspects of taxation, which is a benefit not only for legal science but also for application practice.

The presented monograph is dedicated to the reforms of local administration in the middle of the 19th century, which led to the introduction of municipalism - the nationalization of local administration. The work is primarily devoted to the analysis of the differences between legal articles 42/1870 and 21/1884, the second of which has so far been considered by Slovak legal historians as an amendment. I will explain the differences in the text of both standards, as well as by pointing out the practice of applying both standards in local practice in Abov and Turňa, the legal article 21/1884 is applicable, it is recoded and after the thresholds of the Czechoslovakia it was received as an obligation of the local sparva in Slovakia and is valid even in the time of Conclusion The Trianon peace treaty.

Zborník príspevkov zo VI. študentského sympózia z obchodného práva konaného dňa 28. novembra 2018 na Právnickej fakulte Univerzity Pavla Jozefa Šafárika v Košiciach
Katedra obchodného práva a hospodárskeho práva Právnickej fakulty Univerzity Pavla Jozefa Šafárika v Košiciach zorganizovala v poradí už VI. ročník študentského sympózia z obchodného práva, ktoré sa uskutočnilo dňa 28. novembra 2018 na pôde Právnickej fakulty UPJŠ v Košiciach. Podujatie bolo súčasťou riešenia výskumného projektu VEGA 1/0917/16 „Atypické a faktické vzťahy v obchodnom práve“. Cieľom každoročne organizovaných sympózií je vytvoriť diskusnú platformu pre študentov za účasti mentorov z radov členov katedry, a to učiteľov, vedecko-výskumných pracovníkov ako aj doktorandov.
Téma tohtoročného sympózia sa niesla v znamení ochrany proti obmedzovaniu hospodárskej súťaže. Obmedzovanie súťaže bez možnosti právneho postihu a nápravy by znamenalo pre obmedzovateľa ekonomickú výhodu na úkor ostatných súťažiteľov a ohrozenie celého trhu založenom na slobodnej súťaži. Študenti sa venovali viacerým problematickým otázkam súvisiacim s témou hospodárskej súťaže, pričom analyzovali slovenskú a európsku právnu úpravu, ako aj judikatúru súdov a rozhodnutia iných orgánov.
Pri spracovaní jednotlivých tém študenti mali možnoť zdokonaliť svoje analytické myslenie a argumentačné schopnosti ako aj rozvíjať svoje kritické myslenie. V rámci diskusie sa zrodili ďalšie zaujímave pohľady a názory, ktoré viedli účastníkov sympózia k aktívnemu zapojeniu sa k príspevkom ďalších účastníkov sympózia. Predkladaný zborník je výstupom prác študentov z tohto podujatia.

Občiansky zákonník je jednou zo základných právnych kodifikácií dnešnej doby. Paradoxom je, že v Slovenskej republike dodnes platí zákonník z roku 1964, pravda s istými úpravami, ktoré priniesla moderná doba. V súčasnosti prebiehajú rekodifikačné snahy, ktorých výsledkom by malo byť prijatie nového Občianskeho zákonníka. Nie je však možné budovať nové bez znalosti starého. Je preto dobrým znakom, ak sa na spoločnej konferencií stretnú právni historici s civilistami, aby si vymenili názory a poznatky. Katedra dejín štátu a práva košickej Právnickej fakulty je v roku 2013 v prvom roku riešenia vedeckého grantového projektu VEGA: Historickoprávny vývoj inštitútu kúpnej zmluvy a tendencie jej súčasnej rekodifikácie v SR - č. p.: 1/0131/13. Uvedený projekt sme získali ako historickoprávny, participuje však na ňom aj Katedra občianskeho práva, veď doc. JUDr. K. Kirstová, CSc. je zástupkyňou vedúceho projektu. Vedomí si toho, že ide o úplne unikátne prepojenie právnych dejín a praxe, naša katedra dňa 27. septembra 2013 zorganizovala medzinárodnú vedeckú konferenciu Kúpna zmluva - história a súčasnosť I., ktorá bola plánovaným grantovým výstupom, v konečnom dôsledku sa však konala v čase, kedy košická Právnická fakulta oslavovala 40. výročie svojho vzniku. Tento zborník je teda súhrnom vystúpení z riešenia grantového projektu, ale aj vystúpení, ktoré s riešenou témou súvisia. Má ambíciu výraznou mierou prispieť k poznaniu dejín a súčasných rekodifikačných snáh inštitútu kúpnej zmluvy doma a v zahraničí.

The peer-reviewed Proceeding of Scientific Papers is dedicated to the issue of the European Public Prosecutor's Office and is the result of a scientific project APVV-18-0421 European Public Prosecutor's Office in Connections of the Constitutional Order of the Slovak Republic as Strengthening of the European Integration through Law. In their works, the authors of scientific papers, dealt with the issue of the European Public Prosecutor's Office in the context of European Union law and criminal law, as well as the relation of the European Public Prosecutor's Office with the national prosecutor's office and law enforcement authorities. The scientific works published in the proceeding dealt with the topics of the reasons for the establishment of the European Public Prosecutor's Office, the position of the European Public Prosecutor's Office in the institutional system of the EU and the Slovak Republic, relations of cooperation and coordination between the European Public Prosecutor's Office and the Public Prosecutor's Office of the Slovak Republic, the protection of the constitutionality and legality of the procedures and decisions of the European Public Prosecutor's Office, with special attention to the protection of fundamental rights, as well as the first result and evaluation of the operation of the European Public Prosecutor's Office in the Slovak Republic. Thanks to the content of scientific papers, the reader can get a more comprehensive idea of this new body of the European Union, which operates in an area traditionally associated with state sovereignty and represents another step forward in the integration processes represented by the European Union.

This monograph examines when the state has the right to intervene in the legal relationship between contracting parties, and if it is possible, when it can act as a legislator and/or a law applier and what the nature of the intervention may be. In this study, the limits related to the rights and obligations of the parties are scrutinized. The monograph delineates the theoretical frameworks of state intervention. The author distinguishes the forms of intervention concerning future contracts and those already concluded. The study lists the circumstances grounding the mandatory norms concerning future contracts with the presentation of Roman law. In the context of state influence on the content of contracts already concluded, judicial decisions play a stronger role than legislation and government measures also appear. The monograph presents the legislative measures affecting the contracts already concluded and the reasons thereof in a differentiated way, divided into different periods. In the author's view, World War I and especially the subsequent Treaty of Trianon brought a significant change in the assessment of state intervention, and therefore, he devotes special attention to the examination of this period. The monograph provides an outline of overview of the international tendencies of the period from the peace treaty to the present day. The study presents the era of Hungarian legislation being prone to make mandatory rules and delineates the relevant provisions of the applicable Hungarian law. At the end of the monograph the reader can find the author’s evaluative comments. While acknowledging the positive aspects of state involvement, attention should also be paid to the dangers of excessive state intervention in Eastern Europe.

The scientific monograph The H(andb)ook of Legal Feminism: The Concept, Nature, Features, Development and Forms of Legal Feminism presents for the first time the issue of legal feminism in Slovak jurisprudence in such a comprehensive way. Author analyzes legal feminism as a distinctive movement of legal philosophy and legal theory. He places legal feminism in the broader framework of general feminism. The internal ideological and developmental diversity of legal feminism brings the author´s examinations before the effort to systematize according to ideological and theoretical similarities or differences with emphasize to the development of feminism in different waves. In this regarding, author presents various forms of feminism and legal feminism, including their most important representatives. The increased view of the monograph deals with contemporary Anglo-American feminism since the end of the 1960s till the present, i.e., the period from which legal feminism emerged as a conceptual and critical movement of legal thinking. Author analyzes the critical view of legal feminism on law and current legal policy. He specifies abstract and basic theoretical features of the feminist jurisprudence. In this regard, the author pays attention to important concepts, categories, ideological assumptions, or methodological and methodological frame of feminist legal science. In addition to providing a comprehensive overview of the development of diverse forms of legal feminism the monograph also focuses on the normative side of feminist theory of law, which challenges the modern jurisprudence in elimination of gender and gender as legally relevant criteria.

Predkladaná vedecká monografia sa zaoberá problematikou Rule of Law a jeho miestom, úlohami a osobitosťami na úrovni medzinárodného práva.Predkladaná vedecká monografia sa zaoberá problematikou Rule of Law a jeho miestom, úlohami a osobitosťami na úrovni medzinárodného práva. Law ako hodnote, ktorá by mala vládnuť v jednotlivých spoločenstvách, vnútroštátnych i medzinárodných. Rule of Law je tak prirovnávané k základnej norme Kelsena, ktorá by mala stáť na vrchole právneho poriadku ako norma zdôvodňujúca platnosť a existenciu noriem právneho poriadku, vnútroštátneho i medzinárodného.
Hoci je predmetom skúmania Rule of Law na úrovni medzinárodného práva, nemôžeme o ňom uvažovať bez toho, aby sme pochopili Rule of Law vo vnútroštátnom práve. Podobne ako sa líši vývoj Rule of Law v závislosti od toho, či sa rozvíjalo v anglo-americkom alebo kontinentálnom práve, líši sa i jeho aplikácia a rozvoj na úrovni vnútroštátneho práva a medzinárodného práva. Odlišnosti spôsobujú najmä úlohy a ciele, ktoré má medzinárodné Rule of Law zabezpečiť, no i odlišné vlastnosti vnútroštátneho a medzinárodného práva.

The possibility of solving the grant project VVGS-2016-284 has provided a unique opportunity for members of the author´s team in the interdisciplinary composition to examine the issue not only from a tax-law point of view, but also from a political point of view. In the presented monograph, the authors focused on the characterization of different aspects of the EU in order to allow the reader correctly understand its position in relation to the outside world and to its inward relations within its Member States in the context of the creation and implementation of the EU tax policy. Particular attention is paid to the definition of the relationship between national tax legislation and EU law, the impact of the EU's tax policy on the national laws of its Member States, with reference to the identification of the harmonized areas with the approximation of their current stage of development and the final objective. This definition can be seen as a prerequisite for a correct and comprehensive understanding of the application and implementation of EU institutions' initiatives to prevent tax evasion and tax fraud and their implementation into the national legal order of the Slovak Republic. In the last part of the monograph, the authors focused on defining individual EU initiatives to combat tax evasion and tax fraud as a means of implementing its tax policy, in the area of indirect taxation, in particular in the field of value added tax and in the field of direct taxation, especially with regard to corporate taxation, and to evaluate their projection into the national tax legislation of the Slovak Republic. At the same time, in these chapters, they assessed the real impact and effect of the measures admitted on the basis of the initiatives in practice.
The presented work is intended for a university student studying in the field of Tax Law and European Law, as well as the broader legal and economic community. However, in view of the scope and recency of the subject under consideration, the authors believe that the publication will find its application not only in the theoretical field but also in the practical field.

The Convention on the Protection of Human Rights and Fundamental Freedoms and the case-law of the ECtHR represent a decisive legal instrument for the evolution of the right to a fair trial in the member states of the Council of Europe and the European Union, including the Slovak Republic, which affects the minimum level of procedural guarantees for individuals in judicial and administrative proceedings.
The primary purpose of the textbook is to fill the gap consisting in the absence of a comprehensive study text for undergraduate students at Pavol Jozef Šafarik University in Košice, Faculty of Law for the planned subject Right to a fair trial in administrative issues, and doctoral students at this faculty for the subject Protection of fundamental rights and freedoms in criminal matters according to the case-law of the ECtHR.
However, this textbook is also intended as a supplementary study aid for bachelor students in order to deepen their knowledge of the subject Administrative Law II, the result of which is to acquire knowledge about procedural administrative law in the Slovak Republic, as well as the subject of European Administrative Law, the result of which is the acquisition of knowledge about the influence of Council of Europe law on the national administrative law of the Slovak Republic.

The continuation of the tradition of an international scientific conference of doctoral students and young researchers have not been exception this year. The Department of Labour Law and Social Security Law, Faculty of Law, Pavol Jozef Šafarik University in Košice, as the organizer of this year's international scientific conference, has chosen a topic entitled "Protection, Prevention and Legal Liability."
Because of the unfavorable epidemiological situation and the cancellation of scientific, professional and other mass events, the conference was transferred to a virtual form. The electronic platform of the conference via online discussion was realized from 3rd to 17th April 2020. The protective function of law, preventive obligations, but also the emerging responsibilities are a vast source of ideas for scientific research, asking questions and finding answers to a range of theoretical and application-law problems in every area of public and private law. Evidence of a generously understood topic is the presented proceedings of scientific papers.
The proceedings, created within the solution of the grant task APVV-16-0002 -Mental Health in the Workplace and Employee Health Assessment, includes various aspects of legal regulation, from academic authors and authors from legal practice. Despite the diversity of the scientific focus, the papers are characterized by a unifying line corresponding to the central theme of the conference and show the interconnectedness of the different areas of law.
Učebnica Všeobecnej štátovedy predstavuje tradičný obsah predmetu, ako sa rozvinul v európskej kontinentálnej podobe (altematívou štátovedy je dnes na viacerých univerzitách, aj mimo právnických fakúlt, politická veda). Medzi dvanástimi kapitolami sa okrem viac-menej stabilne prítomných (1. Jednotlivca spoločnosť; 2. Teórie o príčinách vzniku štátu a o účele štátu; 3. Znaky (prvky)štátu; 8. Politické strany a štát) nachádzajú aj kapitoly, ktoré spravidla nie sú, alebo doteraz neboli predmetom štandardného záujmu (5. Politický spor, zmena ústavy, revolúcia, právo na odpor; 6. Rozpadnuté a stroskotané štáty; 7. Štát a cirkev).Niektoré kapitoly predstavujú návrat k pôvodným štátovedným klasifikáciám (9. Funkcie štátu). V rámci prezentácie historických a aktuálnych otázok týkajúcich sa Formy štátu (najrozsiahlejšia 1O. kapitola)ide o pokus objasnit' nové aspekty problematiky(napríklad, podkapitoly ako Parlamentná opozícia, Ústavné súdnictvo). Záverečná časť učebnice sa venuje Modernému ústavnému štátu: právnemu štátu(12.kapitola)a možno ju považovat' za príspevok k analýze princípov právneho štátu a jeho viacerých teórií. Úmyslom autora bolo tiež prispieť k autentickému výkladu názorov niektorých myslitel'ov predošlých období, návratom k pôvodným textom ich diel. Všeobecná štátoveda, adresovaná predovšetkým študentom, má za ciel' tvoriť úvod do právnického štúdia ako jeho osvedčená základňa, zdroj i východisko.

The present monograph deals with the post-war settlement of relations and peace negotiations related to the settlement of the borders of the newly established Czechoslovak Republic. The work discusses in detail the negotiation processes related to the preparation and signing of the Versailles and Saint-Germain Peace Treaties. Similarly, it then discusses in detail the peripeties related to the drafting of the Treaty of Trianon dealing with the border with Hungary and its subsequent delineation in the field. Last but not least, the thesis captures the settling of Czechoslovakia's international relations with Poland and their common border, with a particular focus on the arbitration settlement on the territory of Orava and Spiš.

Health determines an individual's life in all activities and interests, including the possibility and ability to work. Work and health are in the mutual interaction. Work leads to social inclusion, financial self-sufficiency, finding confirmation of one's own usefulness or achieving personal ambitions. Work can have therapeutic effects, but at the same time it can have an adverse effect on health.
Overlapping factors of work environment, alone or in combination with non-work influences, can lead to illnesses that temporarily or permanently exclude an employee from his or her profession. For these reasons, health enjoys fundamental legal protection as one of the most important values, not only in labour relations.

The Department of Commercial Law and Economic Law together with the Department of Labour Law and Social Security Law of the Faculty of Law of UPJŠ in Košice organized the 8th annual student symposium, this time on commercial, labour and private international law, which took place at the Faculty of Law of UPJŠ in Košice on 1 December 2023. The student symposium under the title Commercial and Labour Law on a Common Wave was carried out as part of the research projects VEGA 1/0259/22 and VEGA č. 1/0291/23. The aim of the annual symposia is to create a discussion platform for students under the supervision of mentors from among the members of the department, namely teachers, researchers and PhD students. The theme of this year's symposium brought about discussion of interesting theoretical and practical legal issues thematically focused on the synergy of business law and labour law. The students addressed topical issues related to the status of entrepreneurs, the conduct of companies in labour law relations as well as the duties and responsibilities of employees. The topics of the sharing economy, gender quotas in corporate bodies and unfair bribery were not forgotten. While working on individual topics, students had the opportunity to improve their analytical thinking and argumentation skills, while they could practice writing a legal professional text, which in practice often increases the success of every lawyer. Students had the opportunity to develop their critical thinking and learn how to clearly formulate their own opinions on current legal issues. After the presentation of the papers, not only the team of lecturers and researchers, but also the students themselves engaged in a fruitful discussion, asking a number of original questions. Each student participant was awarded a certificate for their active participation in the symposium. The present proceedings are the outcome of the students' work from this event.
