Zborník príspevkov zo IV. študentského sympózia z práva obchodných spoločností konaného v dňoch 24.-25. novembra 2016 v učebno-výcvikovom zariadení UPJŠ v Danišovciach.

Katedra obchodného práva a hospodárskeho práva Právnickej fakulty Univerzity Pavla Jozefa Šafárika v Košiciach zorganizovala v poradí už IV. ročník študentského sympózia, tentokrát z práva obchodných spoločností, ktoré sa uskutočnilo v dňoch 24. – 25. novembra 2016 v učebno-výcvikovom zariadení UPJŠ v Danišovciach. Cieľom každoročne organizovaných sympózií je vytvoriť diskusnú platformu pre študentov za účasti mentorov z radov členov katedry, a to učiteľov, vedecko-výskumných pracovníkov ako aj doktorandov. Téma tohtoročného sympózia bola zameraná na problematické otázky spojené s právnym postavením spoločníka v obchodnej spoločnosti. Jednotlivé témy boli zadávané tak, aby študenti mohli preukázať a rozvíjať svoje analytické a argumentačné schopnosti, a zároveň sa zdokonalili v prezentácii a formulácii vlastných názorov a pohľadov. Predkladaný zborník je výstupom prác študentov z tohto podujatia.

The Convention on the Protection of Human Rights and Fundamental Freedoms and the case-law of the ECtHR represent a decisive legal instrument for the evolution of the right to a fair trial in the member states of the Council of Europe and the European Union, including the Slovak Republic, which affects the minimum level of procedural guarantees for individuals in judicial and administrative proceedings.

The primary purpose of the textbook is to fill the gap consisting in the absence of a comprehensive study text for undergraduate students at Pavol Jozef Šafarik University in Košice, Faculty of Law for the planned subject Right to a fair trial in administrative issues, and doctoral students at this faculty for the subject Protection of fundamental rights and freedoms in criminal matters according to the case-law of the ECtHR.

However, this textbook is also intended as a supplementary study aid for bachelor students in order to deepen their knowledge of the subject Administrative Law II, the result of which is to acquire knowledge about procedural administrative law in the Slovak Republic, as well as the subject of European Administrative Law, the result of which is the acquisition of knowledge about the influence of Council of Europe law on the national administrative law of the Slovak Republic.

Zborník príspevkov z V. študentského sympózia konaného v dňoch 21. - 22. apríla 2013

Francúzsky delegát v Komisii pre ľudské práva, diskutujúc o zaradení pojmu „médiá" do článku o slobode prejavu v návrhu Medzinárodného paktu o občianskych a politických právach, prezieravo vyzýval ostatných členov komisie k predvídavosti ohľadne informačných médií budúcnosti.1 Diskusia prebehla v roku 1950, kedy o vplyve internetu na spolo- čenské vzťahy ešte naozaj nemohli delegáti tušiť. Keďže je v dnešných dňoch už jasné, že informačné technológie významne vplývajú na právo, medzinárodné právo nevynímajúc, rozhodli sa organizátori študentského sympózia venovať jeho šiesty ročník téme „Informačná spoločnosť a medzinárodné právo".

Študenti Právnickej fakulty sa po prihlásení na sympózium najskôr venovali príprave svojho príspevku, pričom každý z účastníkov mal v prípade potreby k dispozícii konzultanta. Zoznam konzultantov popri členoch Ústavu európskeho práva, oddelenia medzinárodného práva, bol tohto roku rozšírený o odborníka na právo duševného vlastníctva, Mgr. Martina Husovca, absolventa našej Právnickej fakulty a v súčasnosti IMPRS-CI doktoranda pôsobiaceho na Inštitúte Maxa Plancka pre duševné vlastníctvo a súťažné právo. Aj touto cestou ďakujeme, že venoval svoj čas študentom a pomohol im cennou radou pri príprave ich príspevkov. Po ukončení prípravnej fázy sa konalo samotné sympózium, ktorého cieľom bolo prezentovať vypracované príspevky a rozvinúť o nich diskusiu. Prednesené príspevky svojím zameraním odrážali široké spektrum prienikov medzinárodného práva a informačnej spoločnosti.

Ústava Slovenskej republiky garantuje v článku 35 právo každého na slobodnú voľbu povolania a prípravu naň, ako aj právo podnikať a uskutočňovať inú zárobkovú činnosť. Každý má právo slobodne sa rozhodnúť, či si prostriedky na živobytie zabezpečí prácou ako samostatne zárobkovo činná osoba so všetkými dôsledkami a rizikami z toho vyplývajúcimi, alebo ako zamestnanec v pracovnoprávnych vzťahoch výkonom závislej práce. Mantinely a pravidlá výkonu uvedených práv sú regulované predovšetkým predpismi pracovného, obchodného aj daňového práva, s korpusom práv a povinností patriacich osobitne podnikateľom a osobitne zamestnancom. Neustály tlak konkurencie i dôsledky ekonomickej krízy privádzajú zamestnávateľov k hľadaniu cestičiek ako od vykonávateľov práce dosiahnuť čo najviac, za optimalizácie čo najnižších poistných, administratívnych i daňových nákladov. Pracovné pomery so zamestnancami sú ukončované a pod tlakom straty prostriedkov na živobytie sa „dobrovoľne“ menia na vzťahy obchodnoprávne. Nielen táto, ale aj ďalšie deformácie trhu práce konfrontujú subjekty práva na prácu s neférovými praktikami zamestnávateľov, čím minimalizujú možnosť realizácie slobody pri uplatňovaní tohto základného práva.

Riešením malo byť legislatívne zakotvenie definície závislej práce zákonom č. 348/2007 Z. z., ktorým sa novelizoval Zákonník práce. Či sa fenoménu „nútených živností“ a ďalších foriem zastretých pracovnoprávnych vzťahov podarilo vývojom definície závislej práce zabrániť, je základnou výskumnou otázkou viacerých vedeckých príspevkov v predkladanom zborníku vedeckých prác. Ambíciou autorského kolektívu je snaha o identifikáciu negatívnych javov trhu práce v korelácii s nedokonalosťami a medzerami pracovnoprávnej úpravy, ktoré spôsobujú jeho neželané deformácie. Ich dôsledné skúmanie v teoreticko-právnej rovine vyústi do výsledkov a návrhov de lege ferenda, ktoré sú súčasne riešeniami grantového projektu Vega č. 1/0805/13 „Optimalizácia usporiadania modelu pracovných vzťahov na trhu práce v Slovenskej republike“.

The present monograph deals with the post-war settlement of relations and peace negotiations related to the settlement of the borders of the newly established Czechoslovak Republic. The work discusses in detail the negotiation processes related to the preparation and signing of the Versailles and Saint-Germain Peace Treaties. Similarly, it then discusses in detail the peripeties related to the drafting of the Treaty of Trianon dealing with the border with Hungary and its subsequent delineation in the field. Last but not least, the thesis captures the settling of Czechoslovakia's international relations with Poland and their common border, with a particular focus on the arbitration settlement on the territory of Orava and Spiš.

Študentské sympózium je pravidelne poriadané Ústavom medzinárodného práva a európskeho práva a v roku 2017 je konané už jubilejná desiata edícia študentského sympózia, ktoré postupom času záber záujmu rozšírilo aj do oblasti európskeho práva. S tradíciou konania študentských sympózií je spojený aj dobrý zvyk prípravy zborníka príspevkov z každého podujatia. Desiaty ročník pochopiteľne nie je výnimkou a tak sa čitateľom dostáva „do rúk“ desiata edícia zborníka príspevkov študentského sympózia. Po minulé roky bolo sympózium vždy zamerané na konkrétnu oblasť právnej úpravy medzinárodného a európskeho práva. Tak sa predmetom skúmania účastníkov sympózií stali otázky migrácie (2016), ochrany kultúrnych hodnôt (2015) alebo problematike kyberpriestoru (2013). Tento rok sa vzhľadom na to, že ide o jubilejný desiaty ročník organizátori sympózia poňať zameranie sympózia prierezovo a pripomenúť si niektoré významné míľniky vývoja medzinárodného práva, ktoré sa udiali v rokoch ukončených číslom sedem.

Proceedings of the international scientific conference held on April 13-14, 2023, organized by the Department of History of State and Law, Faculty of Law, University of Pavel Jozef Šafárik in Košice. The presented collection provides a summary of scientific works from the last international conference dealing with the issue of the Trianon Peace Treaty and the negotiations during the peace conference after 1918. The collection contains scientific contributions from members of the research team of the APVV 19-0419 project, as well as other experts from the field of legal history. Through their contributions, they offer an insight into the complex processes of the formation of Europe after the First World War. They approximate the essential and relatively complicated processes of negotiations on important issues of the post-war arrangement and the further direction of individual countries. Contributions of foreign legal historians, which bring an alternative view of the examined issue, are a stimulating contribution to the collection. The anthology includes scientific studies related to the investigated issue, often with an overlap with the present. The collection also includes scientific contributions with positive legal topics. The collection in the presented form is thus primarily intended for readers from the professional public. Last but not least, it can interest the lay public interested in the issue of the post-war arrangement and Slovak-Hungarian relations.

Reviewed collection of papers of the international scientific conference is the output of the international scientific conference held on 7th October 2022 within the framework of the project APVV-18-0421 „European Public Prosecutor's Office in Connections of the Constitutional Order of the Slovak Republic as Strengthening of the European Integration through Law“.

Unlike other areas of activities of the European Union, the European Union did not begin to enter the area of criminal law and criminal policy until much later. The reason is that the sphere of criminal law has traditionally been associated with the sovereignty of the state, which is why the Member States of the European Union are very slow to allow the European Union into it. The issue of the European Union's influence on the criminal law of its Member States is therefore becoming actual and raises many questions and application problems. In their papers, the authors address the various problems posed by the European Union's influence in the area of criminal law. Among the scientific problems and issues that the authors paid attention to in their works are the following: reasons for competence of the European Union within the field of criminal law; Impact of the EU legislation on criminal law of EU Member States; proposals to improve existing legislation, whether at European Union or national level, cooperation of the Court of Justice of the European Union and national judges via preliminary proceedings within the field of criminal law; as well as the issue of the European Public Prosecutor's Office.

The text book of scientific contributions The value direction of criminal law is the output of a nationwide interdisciplinary scientific conference with international participation organized by the Department of Criminal Law of the Faculty of Law of the UPJŠ in Košice. The proceedings contain contributions focused on issues of the value direction of criminal law, both in the field of substantive and procedural law.

This is a highly topical issue, as the values of law as such are reflected in each of its areas. In view of social events, the constant amendment of the criminal codes and, in particular, the forthcoming amendment of both the Criminal Code and the Code of Criminal Procedure, we consider the topic of the conference and the title of the text book to be highly topical, without significant limits in scientific research.

In their contributions, the participants of the national interdisciplinary scientific conference with international participation also devoted themselves to reflections de lege ferenda and offer insights into the above-mentioned amendments to the criminal codes into practice as well as their upcoming amendments.

The aim of the published proceedings is to continue to improve and develop new knowledge in the field of criminal law in the light of the new rules, while adhering to all established values, on the basis of the previous professional knowledge.

Methodological guide for teachers for classroom lessons and civics Teaching law experientially? Is it even possible? The answers to these questions are provided by a methodological guide that uniquely links experiential learning methods with legal content. This methodological guide is a set of techniques based on the use of interactive and participatory learning methods, focusing on selected human rights and value-oriented topics, which also have the potential to develop other key competences of students, such as their communication skills, their ability to learn and educate independently, their ability to think critically, their ability to work with and analyse texts, their ability to discuss and express their opinions, and their ability to listen to each other. The methodological guide consists of a set of training activities - techniques, while each technique contains a precise description of the procedure for conducting a specific activity, the expected duration of the activity, aids, discussion topics and also a short pedagogical and legal commentary, precisely "tailored" to the specific legal topic. The legal topics are chosen to be generally applicable to both classroom and civics lessons, to raise questions about the functioning of rules and the need to respect them, mutual respect and tolerance, and to encourage reflection on the limits of individual rights and on responsibility in exercising one's rights. The techniques use training methods such as group work, brainstorming, role-playing, dealing with model situations, as well as a simulated court process. The methodological guide is intended for classroom teachers in the implementation of classroom lessons, and also for the purposes of the subject of civics, as well as for students of pedagogy at the Pavol Jozef Šafárik University in Košice.

Given the importance of the ownership right, the aim of this monograph is to provide an analysis, a clear systematic interpretation and an evaluation of the above issue, not only from the theoretical point of view, but also from the point of view of legal practice. The protection of ownership relations is ensured in various ways. It is judicial protection, protection provided by local self-government authorities, self-help, public registration of real property and other instruments of administrative and criminal law. In connection with the transformation of legislation in Slovakia and Poland after the fall of the socialist regime, there have been many changes in the legislation of both countries concerning the protection of ownership rights. A number of private law institutions related to the ownership of real property, the use of which was impossible or limited during the socialist period, have been restored. Legislation has also been adopted to alleviate the consequences of certain property and other injustices caused by the deprivation of ownership of real property during the socialist period. The adoption of restitution legislation was the basis for restoring the ownership rights of the original owners, who were allowed to get back their real property that had been used by socialist organisations. After the end of the socialist regime, the various forms of ownership, which until then had favoured the state ownership, were abolished. Changes were made to ensure that the ownership rights of all owners had the same content and enjoyed the same legal protection. The monograph is structured in such a way as to enable a comparison of individual institutions of rights in rem under Polish and Slovak law. The monograph also analyses the relevant decision-making practice of the supreme judicial authorities. The scientific methods applied enabled the authors not only to analyse and evaluate the historical context and the current legal regulation of ownership rights in Poland and Slovakia, but also to point out possible gaps and shortcomings and to elaborate de lege ferenda proposals that can be used in future legislative activity.

The presented monograph is dedicated to the reforms of local administration in the middle of the 19th century, which led to the introduction of municipalism - the nationalization of local administration. The work is primarily devoted to the analysis of the differences between legal articles 42/1870 and 21/1884, the second of which has so far been considered by Slovak legal historians as an amendment. I will explain the differences in the text of both standards, as well as by pointing out the practice of applying both standards in local practice in Abov and Turňa, the legal article 21/1884 is applicable, it is recoded and after the thresholds of the Czechoslovakia it was received as an obligation of the local sparva in Slovakia and is valid even in the time of Conclusion The Trianon peace treaty.

Collection of Contributions from the XVth Student Symposium on International Law and European Law, held on April 22, 2022, in a hybrid format, with the participation of students from the Faculty of Law of Pavol Jozef Šafárik University in Košice and the Faculty of Law of Trnava University in Trnava.

The jubilee XV. year of student symposium from international and European law took place at the University of Pavol Jozef Šafárik, faculty of law, on April 22, 2022, symbolically on Day Earth. This year's event was dedicated to the increasingly pressing issue of environmental protection. The topic "Green ambitions in the light of European and international law" appealed to many students, resulting in several interesting contributions, falling under both European Union law and international law. European law currently brings great challenges, but also expectations through the European Green Deal. This is also why several student contributions dealt with topics falling under the European Green Deal, either from the point of view of its individual initiatives in general, or more specifically, in the intentions of Agenda 2030, or the implementation of the so-called green diplomacy.

The other part of contributions dealt with environmental protection within international law. Students addressed issues of an environmental nature in the areas of climate change, international maritime law, atmospheric protection, or the issue of so-called climate refugees. The publication itself is an output of the APVV project APVV-20-0576 "Green ambitions for sustainable development (European Green Deal in the context of international and national law)".
