Kriminalistika – tento samostatný vědní obor, který se vyvíjí staletí, je ovšem spíše moderní disciplínou, která je v současném pojetí známa více jak 130 let. Jednotlivé metody kriminalistiky se rozvíjejí zejména v návaznosti na vědeckotechnický rozvoj, ale i právní úpravu a právní myšlení. Záměrem publikace je pojmout celou materii kriminalistiky stručně, přesně a jasně, aby tato publikace byla nejen vhodnou učební pomůckou, ale také vhodným nástrojem pro samotnou praxi. Cílem publikace je popsat jednotlivé druhy kriminalistických metodik, tedy celý úvod do kriminalistiky, metodiky kriminalistické techniky a taktiky a obecnou část kriminalistické metodiky. Navíc se snaží popsat vybrané metodiky vyšetřování některých trestných činů. Její zaměření je právního charakteru, zejména s důrazem na trestí právo (trestní řád). Přáním autorů je poskytnout dostatečnou a vlastně i základní publikaci pro teorii a i praxi, která podá komplexní představu o kriminalistice. Publikace je zejména určena studentům středních, vyšších odborných, a především vysokých škol, jako základní studijní pomůcka, ale i jako příručka pro odbornou i laickou veřejnost.

Issues of punishment are directly linked to a state’s criminal policy, which is an inseparable part of its social policy. Historically, the state has held a unique dominant position in the realm of punishment. Once the conditions for imposing a penalty are met, the state fulfills its obligation by sentencing through independent courts. However, it does not address questions of satisfaction, which belong to the victim. The victim may be a specific physical person or legal entity that suffered harm due to the criminal act. This harm simultaneously affects civil society as a whole. The state prioritizes its duty to punish and decide on the matter over compensating the harmed individual or civil society.

By mediation in criminal cases, we mean extrajudicial facilitation of resolving disputes between the offender and the harmed party, with the assistance and personal participation of a mediator. The mediator, as an independent and impartial person, helps parties identify their interests and supports them in finding shared, practical, and realistic solutions to the points causing their conflict. Probation refers to monitoring, supervising the accused, defendant, or convicted individual, as well as providing individual assistance to the offender and encouraging them to lead a lawful life. This reduces the risk of recidivism, or repeated criminal behavior.

Proceedings of scientific papers „ Elimination of racism, xenophobia and otherforms of intolerance by means of criminal law. Recodification of Criminal Codes - Current Challenges and Perspectives. " is the output of the national interdisciplinary scientific conference with intemational participation organized by the Department of Criminal Law ofthe Faculty ofLaw of the University of Applied Sciences in Košice. The proceedings contain contributions focused on the issues of elimination of racism, xenophobia and other forms of intolerance by means of criminal law and on the issues of recodification of criminal codes, their current challenges and perspectives, both in the field of substantíve and procedural law.
This is a highly topical issue, as the need to eliminate racism, xenophobia and other forms of intolerance by means of criminal law is an important topic with regard to the social situation. The recodification of the criminal codes in 2024 has significantly affected both the substantíve and procedural areas of criminal law, which is the means of ultima ratio. Considering the social developments and the recent amendments to the pena! codes, we consider the theme of the conference and the titlc of the proceedings to be highly topical, containing a significant scope for scientific research.
The participants of the national interdisciplinary scientific conference with international participation in their contributions also dealt with de lege ferenda considerations and at the same time offered solutions to application problems in the field.
The aim of the published proceedings is to continue to improve and develop new knowledge in the field of criminal law, while respecting human rights and freedoms, based on the existing professional knowledge.

Proceedings of Papers of XVIth year of the student symposium of the Institute of International Law and European Law

Proceedings of Papers of XVIth year of the student symposium of the Institute of International Law and European Law is devoted to selected aspects of the place and role of criminal law from the point of view of contemporary EU law and international law. In their contributions, students deal with current topics of criminal law in the law of the European Union and international law. In the EU law, the most actual issue is the European Public Prosecutor's Office, a body of the EU responsible for investigateing and prosecuting criminal offenses affecting the Union's financial interests.

The first part of papers dealt with the reasons for the establishment of the European Public Prosecutor's Office, its structure and tasks, the issue of conducting the investigation of the European Public Prosecutor's Office in the conditions of the Slovak Republic, as well as with the relations of the European Public Prosecutor's Office with its closest partner, the European Anti-Fraud Office.

The second part of the contributions reflects current issues and challenges of criminal law in international law. Authors in their papers focused on the issue of the International Criminal Tribunal for Ukraine, the legal problems and challenges associated with its creation, on the issue of the crime of aggression before the International Criminal Court, as well as on issues of immunity of state representatives before national courts.

Reviewed collection of papers of the international scientific conference is the output of the international scientific conference held on 7th October 2022 within the framework of the project APVV-18-0421 „European Public Prosecutor's Office in Connections of the Constitutional Order of the Slovak Republic as Strengthening of the European Integration through Law“.

Unlike other areas of activities of the European Union, the European Union did not begin to enter the area of criminal law and criminal policy until much later. The reason is that the sphere of criminal law has traditionally been associated with the sovereignty of the state, which is why the Member States of the European Union are very slow to allow the European Union into it. The issue of the European Union's influence on the criminal law of its Member States is therefore becoming actual and raises many questions and application problems. In their papers, the authors address the various problems posed by the European Union's influence in the area of criminal law. Among the scientific problems and issues that the authors paid attention to in their works are the following: reasons for competence of the European Union within the field of criminal law; Impact of the EU legislation on criminal law of EU Member States; proposals to improve existing legislation, whether at European Union or national level, cooperation of the Court of Justice of the European Union and national judges via preliminary proceedings within the field of criminal law; as well as the issue of the European Public Prosecutor's Office.
